{"id":39718,"date":"2024-03-28T17:31:49","date_gmt":"2024-03-28T16:31:49","guid":{"rendered":"https:\/\/crta.rs\/?p=39718"},"modified":"2024-03-28T17:31:49","modified_gmt":"2024-03-28T16:31:49","slug":"odihr-2023-key-findings-with-corresponding-recommendations","status":"publish","type":"post","link":"https:\/\/crta.rs\/en\/odihr-2023-key-findings-with-corresponding-recommendations\/","title":{"rendered":"ODIHR 2023 &#8211; Key findings with corresponding recommendations"},"content":{"rendered":"<h2><span style=\"font-size: 14pt;\"><b>BLURRED LINE BETWEEN THE STATE AND THE PARTY<\/b><\/span><\/h2>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Finding:<\/span> <i><span style=\"font-weight: 400;\">\u201cdominated by the <\/span><\/i><b><i>decisive involvement of the President<\/i><\/b><i><span style=\"font-weight: 400;\">,<\/span><\/i><i><span style=\"font-weight: 400;\"> which, together with the ruling party\u2019s systemic advantages, <\/span><\/i><b><i>created unjust conditions<\/i><\/b><i><span style=\"font-weight: 400;\">\u201d<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">Finding:<\/span><i><span style=\"font-weight: 400;\"> \u201c<\/span><\/i><b><i>pressure<\/i><\/b><i><span style=\"font-weight: 400;\"> on public sector employees, <\/span><\/i><b><i>misuse of public resources<\/i><\/b><i><span style=\"font-weight: 400;\">, and <\/span><\/i><b><i>voter inducement schemes <\/i><\/b><i><span style=\"font-weight: 400;\">raised concerns about voters\u2019 ability to make a choice free from undue pressure. These practices \u2026 tilted the playing field, and <\/span><\/i><b><i>blurred the line between state and the party, <\/i><\/b><b><i>at odds with international standards and paragraph 5.4 of the 1990 OSCE Copenhagen Doc.<\/i><\/b><i><span style=\"font-weight: 400;\">\u201c<\/span><\/i><\/p>\n<p style=\"padding-left: 40px;\"><b>REC. Priority:<\/b> <span style=\"font-weight: 400;\">The law should <\/span><b>provide for a clear separation between the official functions and campaigning activities of the incumbents.<\/b><span style=\"font-weight: 400;\"> Authorities should take measures to prevent misuse of office and state resources, and any violations should be proactively addressed through proportionate and dissuasive sanctions.\u00a0<\/span><\/p>\n<p style=\"padding-left: 40px;\"><b>REC. Priority:<\/b><span style=\"font-weight: 400;\"> Authorities should <\/span><b>prevent intimidation and pressure on voters<\/b><span style=\"font-weight: 400;\">, including employees of public and state institutions and enterprises, and strengthen the oversight mechanisms.<\/span><\/p>\n<p style=\"padding-left: 40px;\"><b>REC. Other:<\/b><span style=\"font-weight: 400;\"> To <\/span><b>ensure equal campaigning conditions, authorities should implement measures that fully enforce the right of all electoral stakeholders to access and use public premises <\/b><span style=\"font-weight: 400;\">for campaigning on equal terms.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2><span style=\"font-size: 14pt;\"><b>FREQUENCY OF EARLY ELECTIONS AND LACK OF POLITICAL WILL HAMPER ELECTION REFORM<\/b><\/span><\/h2>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Finding:<\/span> <i><span style=\"font-weight: 400;\">\u201cf<\/span><\/i><b><i>requency of early elections<\/i><\/b><i><span style=\"font-weight: 400;\"> has further <\/span><\/i><b><i>eroded public confidence<\/i><\/b><i><span style=\"font-weight: 400;\"> in the functioning of democratic institutions and <\/span><\/i><b><i>together with the lack of political will left needed reforms unaddressed.<\/i><\/b><i><span style=\"font-weight: 400;\">\u201d<\/span><\/i><\/p>\n<p style=\"padding-left: 40px;\"><b>REC. Priority:<\/b><span style=\"font-weight: 400;\"> To effectively address recommendations outlined in this and prior ODIHR election observation reports, <\/span><b>necessary legislative amendments should be initiated well in advance of the next elections through an inclusive consultative process built upon a broad political consensus.<\/b><\/p>\n<p>&nbsp;<\/p>\n<h2><span style=\"font-size: 14pt;\"><b>VOTER REGISTRY COMPROMISED<\/b><\/span><\/h2>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Finding:<\/span><i><span style=\"font-weight: 400;\"> \u201climited mechanisms to effectively scrutinize the UVR and <\/span><\/i><b><i>the absence of detailed data on changes in permanent and temporary registration as well as allegations of numerous deceased persons remaining on the register and claims of large-scale voter migration<\/i><\/b><i><span style=\"font-weight: 400;\"> in relation to local elections significantly eroded public trust in the UVR\u2019s accuracy. This <\/span><\/i><b><i>limited confidence was further exacerbated by a lack of a comprehensive response to these concerns from authorities<\/i><\/b><i><span style=\"font-weight: 400;\">.\u201d<\/span><\/i><\/p>\n<p style=\"padding-left: 40px;\"><b>REC. Priority:<\/b><span style=\"font-weight: 400;\"> To address concerns over the accuracy of voter lists and increase public confidence, the relevant laws, regulations, and practices should be reconsidered to enable access to voter registration data and facilitate the conduct of a meaningful audit of the Unified Voter Register with the participation of relevant stakeholders, including political parties and civil society, in line with data protection standards.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2><span style=\"font-size: 14pt;\"><b>INFORMED CHOICE DETRACTED FROM CITIZENS (MEDIA BIAS)<\/b><\/span><\/h2>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Finding 1:<\/span> <i><span style=\"font-weight: 400;\">\u201ccampaign was <\/span><\/i><b><i>marred<\/i><\/b><i><span style=\"font-weight: 400;\"> by<\/span><\/i><b><i> harsh rhetoric<\/i><\/b><i><span style=\"font-weight: 400;\">, <\/span><\/i><b><i>bias in the media<\/i><\/b><i><span style=\"font-weight: 400;\">, pressure on public sector employees and misuse of public resources.\u201d<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">Finding 2:<\/span><i><span style=\"font-weight: 400;\"> \u201cmost national broadcasters <\/span><\/i><b><i>lacked genuine analytical reporting<\/i><\/b><i><span style=\"font-weight: 400;\">, detracting from the voters\u2019 ability to make an informed choice. \u201c<\/span><\/i><\/p>\n<p style=\"padding-left: 40px;\"><b>REC. Other:<\/b> <span style=\"font-weight: 400;\">To provide impartial information about the contestants and allow voters to make an informed choice, <\/span><b>the media should exercise their right for editorial independence <\/b><span style=\"font-weight: 400;\">and avoid using material produced by parties in news and information programmes, especially during election campaigns.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2><span style=\"font-size: 14pt;\"><b>HARMED FREEDOM OF EXPRESSION, INTIMIDATION OF JOURNALISTS AND HUMAN RIGHTS DEFENDERS<\/b><\/span><\/h2>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Finding 1:<\/span><i><span style=\"font-weight: 400;\"> \u201ca number of concerns about the respect for freedom of expression and cases of <\/span><\/i><b><i>intimidation and harassment<\/i><\/b><i><span style=\"font-weight: 400;\"> of civil activists, other human rights defenders, and journalists, remained unresolved.\u201d<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">Finding 2:<\/span><i><span style=\"font-weight: 400;\"> \u201cauthorities and pro-government media publicly <\/span><\/i><b><i>accused the organization of destabilizing the country\u2019s constitutional order.<\/i><\/b><i><span style=\"font-weight: 400;\">\u201d<\/span><\/i><\/p>\n<p style=\"padding-left: 40px;\"><b>REC. Other Media:<\/b> <span style=\"font-weight: 400;\">The competent authorities should fulfil their duty to protect the safety of media staff through effective and timely measures, including <\/span><b>promptly investigate and bring to justice those involved in attacks on, and ill-treatment of journalists and other media actors<\/b><span style=\"font-weight: 400;\">, as well as publicly condemn all threats against journalists.<\/span><\/p>\n<p style=\"padding-left: 40px;\"><b>REC. Other:<\/b><span style=\"font-weight: 400;\"> Authorities should guarantee adequate conditions for both citizen and international observers to conduct their activities with unimpeded access to all election-related information in a timely manner and in an <\/span><b>environment free from pressure and intimidation<\/b><span style=\"font-weight: 400;\">, in line with Serbia&#8217;s international commitments.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2><span style=\"font-size: 14pt;\"><b>LACK OF OVERSIGHT AND REGULATORY RESPONSE<\/b><\/span><\/h2>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Finding:<\/span> <i><span style=\"font-weight: 400;\">\u201coversight <\/span><\/i><b><i>bodies for campaign and electronic media remained <\/i><\/b><b><i>largely ineffective in deterring violations<\/i><\/b> <i><span style=\"font-weight: 400;\">during the election period.\u201d<\/span><\/i><\/p>\n<p style=\"padding-left: 40px;\"><b>REC. Priority:<\/b> <span style=\"font-weight: 400;\">The<\/span><b> independence of the Electronic Media Regulatory Authority (REM) should be effectively guaranteed<\/b><span style=\"font-weight: 400;\">, in line with the new legal provisions. The REM should proactively use its legal powers to act ex officio on violations of media regulation, based on its systematic monitoring.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2><span style=\"font-size: 14pt;\"><b>LIMITED VOTER EDUCATION<\/b><\/span><\/h2>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Finding:<\/span><i><span style=\"font-weight: 400;\"> \u201cscope of <\/span><\/i><b><i>voter education was limited<\/i><\/b><i><span style=\"font-weight: 400;\">\u201d<\/span><\/i><\/p>\n<p style=\"padding-left: 40px;\"><b>REC. Priority:<\/b> <span style=\"font-weight: 400;\">To enhance the effective exercise of voting rights, the Republic Electoral Commission should develop and implement a timely, comprehensive and targeted voter education programme, including on voters\u2019 rights, the prevention of group voting, and the importance of voting by secret ballot.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2><span style=\"font-size: 14pt;\"><b>LIMITED CAPACITIES OF ELECTION ADMINISTRATION<\/b><\/span><\/h2>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Finding 1:<\/span> <i><span style=\"font-weight: 400;\">\u201cContrary to previous ODIHR recommendations, participation in the training for Polling Board (PB) members <\/span><\/i><b><i>was not mandatory.<\/i><\/b><i><span style=\"font-weight: 400;\">\u201d<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">Finding 2:<\/span> <i><span style=\"font-weight: 400;\">\u201cthe REC largely enjoyed confidence in its technical capacity as well as improved communication and transparency, however, its <\/span><\/i><b><i>lack of a permanent secretariat, along with limited human and financial resources<\/i><\/b><i><span style=\"font-weight: 400;\">, hinders its ability to sustainably improve its work between electoral periods.\u201d<\/span><\/i><\/p>\n<p style=\"padding-left: 40px;\"><b>REC. Priority:<\/b><span style=\"font-weight: 400;\"> As previously recommended, to ensure consistent application of election day procedures and enhance the professional capacity of the election administration, standardized mandatory training could be considered for all Local Electoral Commission and Polling Board members and prospective members, including the extended compositions of these bodies.<\/span><\/p>\n<p style=\"padding-left: 40px;\"><b>REC. Other:<\/b><span style=\"font-weight: 400;\"> To achieve sustainable progress in its activities, such as developing instructions, training election officials, improving voter education campaigns, and enhance the accessibility of the electoral process, the Republic Electoral Commission should be granted sufficient administrative and technical capacity, including its own permanent secretariat.\u00a0<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>BLURRED LINE BETWEEN THE STATE AND THE PARTY &nbsp;
